Sorry if this is a basic question, but I know that we can receive e-mail using Exchange Server smtp directly to our fixed IP address thereby not relying on an ISP's mail servers; however is it possible to send e-mail directly from Exchange without using the the ISP as a host?
Yes. It's an option in the CEICW.
There are currently proposals in the UK about the government retaining copies af all e-mails sent in the UK and
Which proposals would these be?
RIPA requires ISPs to record the metadata about email, not the email contents. Same as for phone calls (telco's record the call numbers, date and duration, they don't record the call itself).
the site in question sends a lot of legally privileged information in e-mails that we would not want read by 3rd parties.
Then the information should not be sent via email, as email is fundamentally insecure. It's the equivalent of a postcard.
Alternatively I suppose we could apply encryption but this appears to rely on the receiving party also being capable of using encryption keys.
It sounds like this ought to be in place already.
