There are currently proposals in the UK about the government retaining copies af all e-mails sent in the UK and the site in question sends a lot of legally privileged information in e-mails that we would not want read by 3rd parties. Alternatively I suppose we could apply encryption but this appears to rely on the receiving party also being capable of using encryption keys.

You can use DNS to send mail directly to the receiving party's MX so you don't need to use your ISP's mail server, but you do still have to use their Internet connection. Your mail can be grabbed at any stage. If you need privacy you do need to use encryption.
