RWDCs do not replicate from RODCs and that's why the RWDCs do not have issues. RODCs need to be able to contact a W2K8 RWDC for replication, authentication forwarding and chained writes. If the RODC and the RWDC are in different AD sites and the sites are not connected to each other directly then it should work OK. If there is another site in between you have a few options. Either enable auto site link bridging or create a custom site link bridge

I have a mixture of W2K3 and W2K8 (including RODC). On my RODC's I get event
id 1311 and 1865 saying unable to form a spanning tree topology. The RODC's
are replicating and there doesn't appear to be a problem - dcdiag ok etc

The sites which appear in the 1865 error all have W2K8 DC's.

Could this be due to my not having a contiguous replication chain of W2K8
DC's between these sites and the RODC's? The errors do not appear on the
upstream (RW) W2K8 DC's to the RODC's.

If so should this be a cause for concern, any ramifications not immediately
apparent?
