As JW said, as long as you use your CD Key, you're legal. But if your nephew has a full retail CD, it won't take the OEM key. And if its an OEM version, it may not install (or fail to activate) on your PC if its from another vendor.
Personally, I'd bite the bullet and spend the $30 on a legit version that you know will install on your system in the future.

Regretably, I formated that partition also. Stupid sometimes. After reading
for hours the posts on this site, I decided to ask my nephew (a hardware
repair guy) to install a copy of XP Home Edition SP2 on my computer and use
my product key (that's on the side of the computer) to validate. Is this
legal and reasonable? Your response will be followed.

how to the provided recovery method. Normally this is a hidden partition on
the hard disk and is access during the initial POST of the computer. This
"recovery partition" is separate from the OS partition, and unless you
formatted that, as well, you should be able to use it to put your system
back to its "out of box" condition.
