Chris, this has nothing to do with "BIOS tying". While large OEMs (Dell, HP, Gateway) have the OPTION to tie an OS to the BIOS, many of them don't (Toshiba does not, at least not on all models), and further, the question is applicable to the "small OEM" copies that system builders buy in 1-10-30 packs (like you would buy from Newegg), where BIOS tieing is not even an option.
