I tried a an experiment and it appears that something with the disclaimer
does cause the computer to say on rather than enter power management.
I booted up 4 computers and let them sit for 30 minutes and they all stayed
at the disclaimer. I then just clicked OK on the disclaimer on two of them
and within 3 minutes from then, the computers sent the monitors into power
manamgement state. I then rebooted all the computers again and this time I
clicked OK right away on the other two computers and within 3 minutes these
two turned off the monitors and the others just sat there.
Here is the policy I set:
Computer -> Win Settings -> Sec. Settins -> Sec Opt:
Interactive Logon: Do Not Display Last Users = Enabled
Interactive Logon: Do Not Require CTRL+ALT+DEL = Enabled
Interactive Logon: Message Text for Users .... = Blah Blah Blah
Interactive Logon: Message Title for users = Big Trouble warning
The Power Management on the computer tested says to shut the monitor off in
3 minutes which it does only after I click the OK and let it sit at the
logon dialog. I really don't want to give up the legal notice but I really
want to save some cash for the company utilizing the Power Managment. With
the cost of energy these days and the number of computers I have we are
talking thousands of dollars per year.

something from the screensaver policies?

I have a policy that turns off the requirement to hit CTRL+ALT+DEL and
turns on the legal notice. Recently I noticed that a the computers no
longer were kicking into the screen savers when they were sitting at
the legal notice before logon.
Does configuring the legal notice option disable the pre-logon screen
savers?
