Yes as far as we know we see hidden files and not quite sure about protected
files.
We have run disk cleanup, check disk, and defraged. We have also deleted
older system restore files and that gained us 2GB. We currently have 7.4GB
free out of 37GB.

Hello,

So you are sure to see both hidden files AND system protected files ?
Did you do a chkdsk on the volume to check for errors ?
