alright gents, here is the answer as I just spoke to the following MS
departments. for those of you who thought MS was the reason recovery/restore
cd's couldn't be sold, you were sorely wrong. ; )
according to MS Partner services, MS pre-sales support, MS volume licensing,
microsoft doesn't have a stance on the CD's resale. It is up to the
manufacturer. So HP and Dell can say yes and that is all the permission you
need. I would ask that if you don't believe, spend the 2 hours on the phone
with the reps from MS to find out. Then come back and state what I wrote as
right.
I am contacting Dell and HP next to see what they need so I can begin
selling these CD's. By the way, the reason you can't sell them on eBay (or
other auction sites) relates to the prices not being set. Restore/recovery
discs can only be sold at a set price.

There is NO transferring of the Licence with Dell, HP, etc's OEM disks.
Dell, HP, etc are all the same.
Recovery disks also include Hardware specific Drivers for that computer, in
most cases.
And, the Licence dies with the original computer, when it finally fails.
End of story.

Wow I had no idea it would be that hard to sell these things! Ugh... I
never heard about the recovery disks being motherboard specific. Is that
something with just Dell's? When I bought recovery Cd's from
www.Recovery-CD.com, I don't remember specifying the MOBO version.

Also, I didn't read the CYA but I suppose I will and post back what I find.
Maybe we can put our heads together and finally resolve whether this is a

I mentioned earlier that your post sorta answered my question as you mention
I can't do it. I would like to know why besides referring me to read the
Dell OEM EULA.
Again, I really am not trying to sound brash as I appreciate everyone's time

to sell the Dell computers along with the Dell recovery CDs in order to
have a legal selling transaction. Would you like to be sued by Dell and
banned forever from selling sites such as eBay?
If you have any further questions, read the Dell OEM Windows XP EULA
which can be found by exploring the Dell recovery CD.
