That is the same situation as any other OEM product, including such
things as home appliances and entertainment items produced by major
manufacturers with the "house brand" labels of large retailers.
The only substantive difference is that most OEM products show only
the brand name of the seller whereas Microsoft has kept their name on
the OEM versions. For example I have a Sears TV set that was
actually made by JVC, but the name JVC does not appear anywhere on the
set or in the documentation - only Sears. It was a service tech that
told me that it was made by JVC and gave me the equivalent JVC model
number for it.

Sears TVs used to be made by Zenith. Neither Zenith nor JVC, however, have a WPA or WGA like program installed on their TVs and, if they did, I would hold them, not Sears, responsible. Sears would merely be guilty of aiding and abetting. The same holds true for Dell and HP.
