I first encountered the same problem with reference to BackOrifice.B
and Wininit.ini (see my report to the thread "Spybot S&D Users"), and
after fixing that I got this error message.
Wininit.ini was indeed unaccessible except when in safe mode but
win.ini is not "in use" so I stronogly suspect that this is just a
problem in Spybot.
I have inspected win.ini for suspicious contents without finding anything.
In fact the message is not a warning of any infection, it is literally a
warning that Spybot could not get access to win.ini for scanning.
