If you have a Win ME or 98 'retail' CD (not a OEM restore one) you can
show it to an XP Upgrade CD's setup program as the needed evidence when
you use it for a New Install, formatting the disk. If you only have a
restore one you would have to restore with it first.
But the important matter in licensing is the Product Key - the 25
character one. If you find that out (eg by getting and running the
free Everest Home edition from
http://www.lavalys.com/index.php?page=product&view=1 - its Operating
System - Operating system page) and note your Product ID from Control
Panel - System, you should be able to call MSoft support and get a
replacement CD for a nominal charge. If that is an Upgrade one, or you
have to buy an upgrade one in the end, and also have no 98/ME CD, you
could then look for a cheap Win98 CD on eBay say as the evidence
