The installation files may be somewhere on the HDD, f. e. in a hidden
partition. Ask Toshiba how you can reinstall Windows if this is
required.

No. Usually you can upgrade to an original Windows version without
problems. But you may want to contact Toshiba about that as well to be
on the safe side.
