I know that software piracy is an important issue to Microsoft. As a.
programmer it is an important issue to me as well. I am, however,
cautious about being overly or inappropriately concerned especially
to the extent of intentionally embarrassing someone who has purchased
a copy of the software from a friend. While this might give me
grounds for legal action against my customer I would refrain from
embarrassing his friend and my potential new customer by constantly
reminding him that the copy he had purchased was not purchased from
me. Good sense dictates that limit my recovery effort to asking the
court to require my customer pay for the copy he had sold to is
friend. Instead of embarrassing his friend and making him not want to
deal with me in the future by displaying selfish banners and pop-ups
about the copy not being "genuine" would treat his friend as the
original purchaser instead spending my time assuring that he had all
documentation, support and updates. I would go after the original
purchaser for payment and not him.
In practice I have been very successful doing this and by so doing
have won new customers on good references from of my original
customer's friend. The courts have been happy to oblige in making the
original customer pay while the customer's friend. In some cases
where the original customer was voluntarily remittent I have actually
been able to give him a commission for his "sale" and to encourage
him to sell even more. Sort of like helping him to become my Avon
lady and it has worked out well. .
