At a quick thought if you don't find any other hardware resources conflicting with it, the files are corrupt, the chipsets or something else inside the box is going south. It's another high probability that another Sound app isn't playing nice and keeps yanking the rug out from under SoundMax.
I would:
Uninstall everything related to SoundMax.
Boot to Safe Mode > Device Manager and remove any/all devices related to SoundMax.
Remove any/all SoundMax leftovers in Explore.
Delete everything in C:\Documents and Settings\You user name folder\Local Settings\Temp.
Delete everything in C:\Windows\Prefetch
Hunt down and remove everything leftover in the registry related to SoundMax, of course not without exporting the Key/Hive first in case something goes awry.
Reboot and reinstall SoundMax.

is it possible that it needs to start with windows.. I Might have removed it

Yes sir I did... In device manager... under the sound, video and game
controllers... it has Audio Codecs, Legacy Audio Drivers,Legacy Video
Capture Devices, Media Control Devices, SoundMAX Integrated Digital Audio,
Standard Game Port and Video Codecs.. My sound is Sound Max, a part of the

If as you say that you have onboard/integrated sound/video chipset, then
you need
to get the appropriate sound/video chipset drivers from the motherboard

Open the folder and double-click everest.exe to run the application.

Next:
Click the + next to Computer.
Click Summary.
Right click in the right pane and in the popup menu click "Copy All".
