of windows loads. I can load some programs but some critical files
missing, I reboot and when asked to format I hit yes and try again

As for your original problem, if the cd is good (you can test it in
another system), then you have other hardware issues. It doesn't matter
if the hardware is new; in fact if hardware is going to fail it will
usually do so pretty quickly. I'd test the RAM and then the hard drive.
