Deleting a file from the desktop shouldn't be a big deal so long as you
have the permission (login) to do that. Are you sure the file (or
program) isn't open somewhere in the system?

my dilemma is that the folder is on my desktop,to delete from the bottom
of it will cause loss of at least part of my user profile and data!
I've seen something as I recall is called "tagging" a folder... I saw this
in a couple of servers invaded by malicious hackers... they created a
directory called COM4:^H^H^H^H^Hxpto
So all you see is a directory called "xpto" in explorer... but, because
COM4: is a device Windows API isn't able to delete it... does anyone have a
solution for this scenario?
