Web Part Menue - problem with rights bug?

on all pages else then Home i get in the
Web Part Menue - > the option Modify Shared Webpart - WHY?

the teamuser have only rights to read / add / delete / view list entries - no other rights!!
On the Home - all is ok, but on the Page1....Page n there are in the Web Part Menue - > the option Modify Shared Webpart
and the user can change options?!

I use -> "Meating Workspace" (horizontal display of availabel pages) like Home / Page1 / Page2 ... Pagen

There are also NO-Personal Rights,List Rights -add,edit,delete and for Site Rights only View Pages

any idea? - bug?
