First, I am not an attorney, however, the law states you must make a
reasonable attempt to make your agreement accessible. This means it should
be in plain view. So, what I do is...
I build a page with my AUP. On my logon page, I provide a link to that AUP
page. On my logon page I have something similar to:
By using this site, you agree to be bound to the terms in the Acceptable Use
Policy. If you do not agree, you must disconnect now.
Acceptable Use Policy is a link to the page so they can read it. You can
also, if you want, put a checkbox. If the checkbox is not checked, don't
accept the logon or do not even show the logon fields. This should solve
your issue.
