Not at all. If something comes with source code, the comments are part of that source code. I am not a laywer, but I would think that if you have an obligation to provide source code as part of a project and strip out the comments, that you could be found to be in violation of the obligation.

If you paid for commented code, you'd be right.
If you paid for the code only, you can't ask for comments.
Certain things must be discussed *before* signing and paying.
