It is recommended that at least one Active Directory domain operate
  in native mode. This permits Exchange Server 5.5 distribution lists
  (DLs) to be mapped across to Universal Distribution Groups (UDGs) and
  Universal Security Groups (USGs) in Active Directory. The Active
  Directory Connector (ADC) is hard-coded to create UDGs, but the
  Exchange 2000 information store can and will convert these to USGs on
  an as-needed basis. You can configure a secondary recipient connection
  agreement to replicate only DLs to the target native mode domain where
  USGs can exist. If UDGs exist in a mixed-mode domain, they cannot be
  converted into USGs, and your public folder permissions will not work.

The same is true for Exchange 2003. Although you can use DLs in 5.5 for
permissions on public folders and mailboxes because Exchange 200X is so
integrated into AD only Security groups can be used for permissioning. If
you are not in native mode for Windows the ACLs that you have set on
mailboxes and public folders by DL in 5.5 will not be properly converted and
you will break permissions on those objects.

The best method is the one described above where you have a native mode
domain in your forest and to migrate DLs there from 5.5.
