Race condition would be a stretch here. You could enable some Message Tracking to see how fast the messages are being processed and delivered to confirm. I would recommend Postini or Spam Soap to your client. Price it out, you may be surprised the cost are very comparable and you will get so much more in features and support.

I have consider Postini and now might have to persuade my client of doing so..
Below is what cloud mark informed me that why it worked in Exhange 2000 and
not 2007. What do you guys think?

That is a very good point. I prefer Spam Soap which gives you an email link
to your Spam Folder on the Spam Soap servers similar to Postini and others.
